Terms of use

These terms of use set out the conditions for accessing and using the website, the application and the services offered under the name Skiway.

By accessing or using the service, the user acknowledges that they have read, understood and accepted these terms of use. If the user does not accept these terms, they must immediately stop using Skiway.

1. Definitions

In these terms of use, the terms below have the following meaning:

• "Skiway" means the website, the application, the interfaces, the features, the content and the services offered under the Skiway brand.
• "Publisher" means the natural or legal person responsible for publishing the Skiway service, identified in the legal notice.
• "User" means any person who accesses or uses the service, with or without an account.
• "Account" means the personal space that the user may create in order to access certain features.
• "Service" means all the features offered by Skiway, in particular the features for viewing, routes, navigation, groups, location, recommendations or information related to ski areas.
• "Third-party data" means data from external sources, such as maps, ski area information, weather data, run or ski lift opening information, resort names or technical data.

The publisher of the service is identified in the legal notice.

3. Purpose of the service

Skiway is a digital service intended to support users in preparing, organising and improving their experience in ski areas.

The service may, in particular, offer features for viewing maps, route search, navigation, location, group tracking, position sharing, viewing information related to runs or ski lifts, or route recommendations.

Skiway is an information and organisation aid. It is not a professional guiding service, a rescue service, a safety device, an avalanche alert device, a real-time monitoring tool, nor a guarantee that a route is practicable.

4. Acceptance of the terms

Use of the service implies full and unreserved acceptance of these terms of use.

When the user creates an account, uses an advanced feature, joins a group, shares their position, takes out an offer or uses the service on an ongoing basis, they confirm their acceptance of these terms.

The user declares that they have the legal capacity necessary to accept these terms and use the service.

5. Access to the service

The service is accessible from compatible devices, subject to an internet connection, a compatible terminal, a compatible operating system and, where applicable, the activation of certain technical permissions such as location.

The publisher does not guarantee that the service will be permanently, continuously, quickly, securely or error-free accessible. The service may be interrupted, suspended, limited or modified for reasons of maintenance, security, updates, technical development or force majeure.

The user is responsible for their equipment, their connection, their device's battery, the quality of the available mobile network and the charges billed by their operators or access providers.

6. Account creation and management

Certain features may require the creation of an account. The user undertakes to provide accurate, complete and up-to-date information when registering and to keep it up to date throughout their use of the service.

The user is solely responsible for the confidentiality of their credentials and for all actions carried out from their account. Any use of the account is presumed to be carried out by the user, unless proven otherwise.

In the event of loss, theft, fraudulent or unauthorised use of their credentials, the user must inform Skiway as soon as possible at: mathieu@skiway.app.

The publisher reserves the right to suspend or delete an account in the event of a breach of these terms, abusive use, security risk, fraud, an attempt to harm the service or a legitimate request from a competent authority.

7. Use in the mountains and inherent risks

The user acknowledges that skiing, snowboarding, ski touring, freeriding and, more generally, mountain activities involve inherent risks that may result in material damage, serious injury or death.

These risks may result, in particular, from weather conditions, the state of the snow, the opening or closing of runs, the state of the ski lifts, the terrain, visibility, crowds, the user's technical level, their equipment, their behaviour, signage, natural or man-made obstacles, or decisions taken on site by the ski area operators.

The user remains solely responsible for their decisions, their route, their level of practice, their equipment, their behaviour on the runs, compliance with safety instructions and their ability to operate in the conditions encountered.

Before any outing, the user must check the official information provided by the resort, the ski lift operators, the weather services, the avalanche risk assessment bulletins where relevant, the local instructions and the decisions of the competent authorities.

8. No rescue or safety service

Skiway is not a rescue, monitoring, alert, emergency geolocation or personal safety service.

The location, group, position-sharing, community-alert or assistance features that Skiway may offer never replace the official rescue services, ski patrols, mountain professionals, public authorities or the safety arrangements put in place by the resorts.

In the event of an emergency, injury, danger, disappearance, suspected avalanche or a situation requiring intervention, the user must immediately contact the competent rescue services or the resort's safety staff.

The user must never delay a call for help on the grounds that they are using Skiway or waiting for information from the service.

9. Routes, navigation and recommendations

The routes, route suggestions, travel times, difficulty levels, recommendations, directions, maps or information displayed in Skiway are provided for information purposes only.

This information may be incomplete, inaccurate, out of date, unavailable or unsuited to the actual conditions encountered on the ground.

The user must not blindly follow a recommendation or route suggested by Skiway. They must adapt their decisions to their level, the actual conditions, the signage, the resort's instructions, the state of the ski area and the official information available.

Skiway does not guarantee that a suggested route is open, safe, practicable, suited to the user's level, free of danger or compliant with the actual conditions at the time of use.

10. Location data

Certain features may require access to the user's location. The user may be asked to authorise access to their position from their device or operating system settings.

The accuracy of the location depends, in particular, on the terminal used, the GPS, the mobile network, the topography, the weather conditions, the device settings and third-party technical services.

Skiway does not guarantee the accuracy, availability, continuity or precision of the geolocation. A displayed position may be wrong, delayed, approximate or unavailable.

The user must not use Skiway as their only means of orientation, locating, safety or positioning in the mountains.

11. Group features and position sharing

Skiway may offer features allowing several users to create or join a group, share their position, follow certain members or exchange information.

The user is responsible for the people with whom they choose to share their position or certain information. They must make sure they understand the consequences of sharing their position before using these features.

The position of a group member may be inaccurate, delayed, unavailable or no longer reflect their actual position. The absence of a user's display, a frozen position or an unusual position does not necessarily constitute a reliable alert.

The group features must not be used as an emergency monitoring, rescue, parental control, missing-person search or critical safety device.

12. Third-party data and external information

Skiway may use or display data from third parties, in particular map, weather, topographic, run-opening, ski-lift-opening or ski area information data.

This data is provided by its respective sources and may be modified, interrupted, removed, unavailable or inaccurate without notice.

Skiway does not guarantee the accuracy, freshness, completeness, availability or relevance of third-party data. The user must always check important information with the relevant official sources.

13. User obligations

The user undertakes to use Skiway in a fair, reasonable manner, in accordance with these terms and with the applicable laws and regulations.

The user undertakes in particular to:

• comply with the safety rules applicable at the resort;
• comply with signage, run closures and local instructions;
• adapt their behaviour to their level and to the actual conditions;
• not use Skiway as their only means of orientation or safety;
• not transmit content that is unlawful, misleading, insulting, violent or harmful to the rights of third parties;
• not impersonate another person;
• not attempt to gain fraudulent access to the service, its systems or its data;
• not disrupt, overload, degrade or divert the operation of the service;
• not extract, copy or massively reuse the service's data without authorisation;
• not use the service for the purposes of harassment, abusive monitoring or endangering others.

14. Content submitted by the user

If the service allows the user to publish, transmit, share or record content, the user remains solely responsible for that content.

The user warrants that they hold all the rights necessary to the content they transmit and that this content does not infringe the rights of third parties, the law, public order or these terms.

The publisher reserves the right to remove, limit or make inaccessible any content that is manifestly unlawful, abusive, fraudulent, dangerous, contrary to these terms or credibly reported by a third party.

15. Reporting abuse

Any user may report content, behaviour, a security breach, identity theft or abusive use of the service at the following address: mathieu@skiway.app.

The report must contain the information needed to identify the content or behaviour concerned, its location in the service, the reasons for the report and the requester's contact details where this is necessary to handle the request.

16. Intellectual property

The service, its structure, its interfaces, its texts, its visuals, its logos, its graphic elements, its databases, its software components, its code, its name, its brand and, more generally, all of its elements are protected by intellectual property rights.

Unless otherwise authorised in writing in advance by the publisher, the user shall refrain from any reproduction, representation, adaptation, modification, translation, extraction, reuse, distribution or exploitation, in whole or in part, of the service or of any of its elements.

Use of the service confers on the user no ownership right over Skiway, its content, its data, its trademarks, its interfaces or its technical elements.

17. Licence to use

Subject to compliance with these terms, the publisher grants the user a personal, limited, non-exclusive, non-transferable and revocable licence to access and use the service, solely for their personal or internal needs, in accordance with Skiway's purpose.

This licence does not allow the user to copy, resell, modify, distribute, rent, decompile, disassemble, reverse-engineer or commercially exploit all or part of the service, except with prior written authorisation or an applicable mandatory right.

18. User feedback and suggestions

The user may send Skiway ideas, suggestions, corrections, comments or improvement proposals.

Unless otherwise agreed in writing, the user authorises Skiway to use this feedback freely in order to improve, modify or develop the service, without any obligation of remuneration, confidentiality or integration.

19. Personal data

Use of Skiway may involve the processing of personal data, in particular identification, account, contact, usage, device and, where necessary, location data.

The terms governing the processing of personal data are detailed in the Privacy policy.

The user is invited to read this policy carefully in order to understand which data is processed, for which purposes, on which legal bases, for which periods, with which recipients and according to which rights.

20. Cookies and trackers

Skiway may use cookies or similar technologies to ensure the operation of the service, measure its audience, improve the user experience or offer certain features.

The terms of use of cookies and trackers are specified in the Cookie policy.

21. Third-party services

The service may integrate or redirect to third-party services, in particular map providers, authentication services, hosting services, analytics services, payment services, weather services or resort websites.

These third-party services are subject to their own terms of use and privacy policies. Skiway does not control these services and cannot be held responsible for their content, their availability, their security, their operation or their practices.

22. Availability, maintenance and development

The publisher may modify, correct, improve, suspend or remove all or part of the service at any time, in particular for technical, operational, legal, commercial or security reasons.

Certain features may be offered in an experimental or beta version. They may contain errors, be modified quickly, be limited or be removed without notice.

The user acknowledges that the service may depend on many external factors, in particular mobile networks, operating systems, GPS services, data providers and hosting infrastructure.

23. Suspension or removal of access

The publisher may suspend, limit or remove a user's access to the service in the event of a breach of these terms, fraud, an intrusion attempt, abusive use, a risk to the security of the service, infringement of the rights of third parties or a request from a competent authority.

Where reasonably possible, the user concerned may be informed of the measure taken and the main reasons, unless there is a legal requirement, a security imperative or a risk of aggravating the harm.

24. Limitation of liability

Within the limits permitted by law, Skiway cannot be held responsible for damage resulting from a non-compliant use of the service, a decision taken by the user on the basis of indicative information, a location error, inaccurate data, unavailability of the service, a network failure, a terminal failure, a discharged battery or a failure of a third-party service.

Skiway cannot be held responsible for accidents, injuries, material damage, loss of opportunity, loss of data, indirect harm or consequences related to skiing, snowboarding or mountain activities, where these result in particular from the user's decisions, the actual conditions on the ground, the behaviour of third parties, the weather conditions, the state of the ski area or information from third-party sources.

No provision of these terms may have the effect of excluding or limiting a liability that could not be excluded or limited under the applicable law.

25. Warranty

The service is provided as is and according to its availability. The publisher does not guarantee that the service will perfectly meet the user's expectations, that it will be error-free, that it will operate without interruption, that it will be compatible with all terminals or that it will be available in all geographic areas.

The legal guarantees applicable to consumers, where they are mandatory, remain applicable under the conditions provided by law.

26. Force majeure

The publisher cannot be held responsible for a delay, interruption, non-performance or degradation of the service caused by an event reasonably beyond its control.

Such events may include, in particular, natural disasters, bad weather, avalanches, fires, power outages, network failures, cyberattacks, strikes, administrative decisions, unavailability of third-party providers, restrictions on access to ski areas or any event having the characteristics of force majeure within the meaning of the applicable law.

27. Evidence

The user accepts that the technical logs, connection histories, usage traces, electronic validations, emails, notifications and records kept by Skiway may be used as evidence, within the limits provided by law and in compliance with the regulations applicable to personal data.

28. Changes to the terms

The publisher may amend these terms to take account of changes in the service, the regulations, its business model, its technical constraints or its security needs.

In the event of a substantial change, the user may be informed by any appropriate means, in particular by display on the website, notification in the app or email where the publisher has their address.

Use of the service after the new terms come into force constitutes acceptance of them. If the user refuses the new terms, they must stop using the service.

29. Term and termination

These terms apply throughout the user's use of the service.

The user may stop using the service at any time. Where the service allows the creation of an account, the user may request the deletion of their account according to the methods provided in the service or by contacting Skiway at: mathieu@skiway.app.

Deleting the account may result in the deletion or anonymisation of certain data, subject to the legal retention obligations, the publisher's legitimate interests and the rules described in the privacy policy.

30. Complaints

For any complaint relating to the service, the user may contact Skiway at the following address: mathieu@skiway.app.

The complaint must clearly describe the problem encountered, the account concerned where applicable, the date of the facts, the features concerned and any information useful for handling it.

31. Partial invalidity

If a provision of these terms is declared null, unenforceable or deemed unwritten, the other provisions will retain their full effect, unless the provision concerned constituted an essential element of the agreement between the user and the publisher.

32. Applicable law

These terms are governed by French law, subject to the mandatory rules applicable in the user's country of residence where these cannot be set aside contractually.

33. Competent jurisdiction

In the event of a dispute, the parties will endeavour to find an amicable solution before any legal action.

Failing an amicable resolution, the dispute will be submitted to the competent courts under the conditions provided by the applicable law. Where the user acts as a consumer, they benefit from the mandatory rules of jurisdiction provided by the applicable regulations.
